By accessing or using the Cemetery Direct website ("Site") and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Site or our services. These Terms apply to all visitors, users, and partners who access or use the Site.
Cemetery Direct provides a partnership program that enables state-run and publicly operated cemeteries to offer headstones and memorial products directly to families. Through our program, partner cemeteries can offer these products with no upfront inventory costs and earn a revenue share on each sale. The specific terms of any partnership arrangement are governed by a separate Partnership Agreement between Cemetery Direct and the partner cemetery.
You agree to use the Site only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use of the Site. You may not use the Site to transmit any harmful, threatening, or unlawful material, or to impersonate any person or entity. We reserve the right to terminate your access to the Site at our sole discretion if we believe you have violated these Terms.
All content on this Site — including but not limited to text, graphics, logos, images, product designs, and software — is the property of Cemetery Direct or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.
We make every effort to display our headstone and memorial products as accurately as possible. However, due to the nature of natural stone materials, actual products may vary slightly in color, pattern, and texture from what is shown on the Site. All prices are subject to change without notice. Final pricing for partner cemeteries is established in the Partnership Agreement.
Participation in the Cemetery Direct Partnership Program is subject to approval and execution of a separate Partnership Agreement. Revenue share percentages, payment terms, and program specifics are detailed in that agreement. Cemetery Direct reserves the right to modify the partnership program terms with reasonable notice to existing partners. Submission of a partnership inquiry through the Site does not guarantee acceptance into the program.
To the fullest extent permitted by law, Cemetery Direct and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you have paid to Cemetery Direct in the twelve (12) months preceding the claim.
The Site and all content, products, and services provided through it are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied. Cemetery Direct does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
You agree to indemnify, defend, and hold harmless Cemetery Direct and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Iowa.
Cemetery Direct reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
